DUTIES:

  • Reporting to the Lead Prosecutor, this position will be responsible to assist the Lead Prosecutor in the proper administration of justice by conducting Provincial Offences prosecutions on behalf of the Crown, for the City and 9 other serviced municipalities, in both official languages.
  • Will be required to research, prepare, and present oral and/or written argument in Provincial Offences Court. 
  • Will be required to conduct first attendances, early resolutions, trials, judicial pre-trials, motions, appeals (before appellate courts), and all other court appearances. 
  • Will assist enforcement personnel with non-standard charges and opinions as to proper charges to be laid.
  • Will liaise with defendants and their representatives respecting disclosure matters, evidentiary issues, potential resolution of charges, and joint sentencing submissions. 
  • Will assist staff in providing disclosure to the defence. 
  • Will scan disclosure, exhibits and other paperwork as required in order to conduct prosecutions virtually (paperless) as required.
  • Will assist in the enforcement and collection of defaulted fines, in drafting letters and court documentation.
  • Will provide general legal/paralegal services to City departments as required. 
  • May be required to perform associated civil litigation particularly for collections of unpaid fines and statutory interpretation.
  • Will perform Occupational Health & Safety duties as outlined in the Corporation’s Health and Safety Program.   
  • Will provide other duties to the City as required/available.

QUALIFICATIONS:

  • Must be a licensed paralegal or lawyer qualified to practice in the province of Ontario, and must be a member in good standing with the Law Society of Ontario with a minimum of two (2) years of experience (inclusive of a field placement, articling or the paralegal training period) in a Law office and court administration
  • Must be bilingual in English and French;
  • Must have the ability to travel to off-site locations in a timely and expedient manner as required.  If method of travel is by vehicle, a current valid and lawful driver’s licence is required in accordance with the Highway Traffic Act.
  • Must have knowledge of legislation and processes related to POA matters.
  • Must be fully computer literate and well versed in the MS Office suite, particularly Outlook and Word (Excel and Access skills will be considered assets).
  • Must be able to effectively use Westlaw@Carswell and Internet resources for legal research.
  • Must have proven communication, analytical, interpersonal, and research skills, as well as the ability to establish and maintain effective relationships with City representatives, enforcement personnel, other agencies and the general public.
  • Must be conversant with all aspects of judicial system and be able to interact with judiciary, prosecutors and defence counsel
  • Should have knowledge of the Occupational Health and Safety Act, its regulations and knowledge of the hazards associated with the work.
  • Given that this job is a new position a Physical Demands analysis will be completed with the incumbent after approximately six months of occupying the position.
